Is this the worst "model release" ever?
On another site I belong to there's a thread from a model about issues getting paid, as in finding paid work, in a new market. There's a lot of the usual awful advice, and a lot of people not really reading the OP so they think she means "trouble collecting from jobs," which isn't the case. Just now someone wandered in & suggested she "fix" it by demanding possibly the worst "model release" I have ever seen:
Use this model release.
It makes the ownership of you photos both yours and the photographers, so you can market your photos just like the photographer does.
Never sign your rights away for free.
TFCD (Trade for CD) model release
In consideration of my engagement as a model, upon the terms herewith stated, I hereby give to _________________________, his/her heirs, legal representatives and assigns, those for whom_________________________ is acting, and those acting with his/her authority my permission to use images of me in his/her possession taken on this day,________________________.
This permission is subject to the following terms and conditions:
1. That all of the images taken shall be provided to me in a form agreeable to the photographer and myself. (CD’s, DVD’s and memory sticks are acceptable.)
2. That all the images be provided to me within 30 calendar days from the date this agreement is signed. Failure to provide the images within the agreed 30 calendar days will constitute forfeiture of this agreement and the photographer will lose all rights as herein defined.
3. That ownership of the images be shared by myself and ____________________.
4. I give the unrestricted right and permission to use, re-use, publish, and republish photographic portraits or pictures of me or in which I may be included intact or in part, composite or distorted in character or form, including reasonable changes or transformations or reproduction hereof in color or in character or form, now or hereafter for purposes of the Photographer’s self-promotion, such as website galleries, portfolios in recognized modeling online communities, postings to legitimate photography forums, online communities, portfolio books, business cards and the like.
5. I am authorized to use these images for purposes of self-promotion in the same manner as the Photographer, or in any other manor.
6. I acknowledge and agree that this release and agreement shall hold harmless the photographer, and shall continue indefinitely.
7. I hereby affirm that I am over the age of majority and have the right to contract in my own name. I have read the above authorization, release and agreement, prior to its execution; I fully understand the contents thereof.
This agreement shall be binding upon me and my heirs, legal representatives and assigns.

That is NOT a release. That is a CONTRACT incorporating portions of a release, a usage agreement, and other language like time clauses.
It's also poorly worded, legally dubious (where in this case "dubious" means "holes you can drive a truck thru"), and full of misspellings (ie "manor" instead of "manner").
No intelligent self-respecting photographer is going to do anything but laugh at something like that, even if the legal issues and spelling problems were fixed it would be a HUGELY problematic document because of severability issues (ask your attorney if you don't know what I mean).
If a model is seeking a publicity-only trade or a trade where she also has full rights to the image, that's fine. She needs to sign a modified release, or sign a release and then get a usage license from the photographer. That needs to be negotiated up front.
THIS hot mess you suggested not only won't fix the OP's problem, it'll ensure she doesn't get to work with decent people.
I'll tell you right now that if you're using this for your shoots you could be looking at some serious legal issues.
I know we've all seen some pretty feeble language online when it comes to things like this, but this's gotta be one of the most egregious I've come across. Anyone have examples of worse?

What a total crock. I'm surprised that contract doesn't require that the images be edited as well!
EPIC FAIL!!!

Actually guys, I read the above contract over again and have come to the conclusion that it's, without a doubt, one of Wronkled Mags best releases for the GWC shooter, and should be included in the next issue. Why so?
Most models look over the portfolios of all those offering TF, and if the work is stellar will shoot that project. If the work doesn't measure up, they will counter with paid rates.
The above is the perfect counter offer for the cheap GWC who doesn't want to pay those rates, but still wants to get her nekkid in front of his camera. "But, but, you will have ALL the content shot and can use it any way you want to!" (and I won't have to pay you squat, heh, heh!)
Well played GWC, well played!

I made the mistake once of sending a "model" a copy of my release. She emailed it back to me a few days later with some "edits" that would make it acceptable to her. What she sent back to me was over 20 pages of drivel that included a demand that the studio space be "OSHA Certified" and that I produce air and water testing for the studio. Additionally, she wanted to be reimbursed for all laundering, dry cleaning, and alteration fees for the clothing she was going to wear. Then there was the little piece of it that required me to provide her with 100 8x10s and 250 5x7s of each shot we took. The clincher was the statement saying that my telephonic agreement to do a shoot with her bound me retroactively to all the terms she "edited" into my release. She claimed to have a "supreme" legal advisor.
Of course, I told her to go shit in her hat and that she needed to fire the attorney that advised her. Her response was that Jesus himself was her legal advisor. I suggested that she check to see if Jesus was licensed to practice law in Illinois.
Needless to say, we never shot together.
So, I've been meaning to ask you..... how'd your shoot with Mary Magdalen go?
It didn't...Mary doesn't do TFP.
Ah yes, I forgot. She has the same "supreme" legal advisor, manager/boyfriend. My bad.
This completely made my day, and the sun isn't even up yet! Thanks for sharing!
