It doesn't change their status to employee, it just gives then new rights as an independent contractor.
And it would not affect photographers who hire models if the photographers are "individuals" - only if they hire them from their company...

It definatly draws attention to the designer. I guess being unclothed would draw less attention away from the hat than clothing would in the long run. Its just a situation people are not use to.
